We are looking for an experienced Senior Contracts & Claims Manager to join our team in an exciting period of change and growth for our business. You will be working in a Programme of projects in the Construction Sector, for a fixed-term contract. The selected Senior Contracts & Claims Manager will need to have contract experience in the construction industry.
Summary of the role
To provide Contract Management at a senior experienced level, in accordance with the Programme execution plan on a number of Projects.
Key Responsibilities
- Reports to the PMO Director, managing all contract related issues of the Project/Program and of the service providers’ agreements (the contracts) for the Project/Program.
- Generate and compile Request for Information (RFI) and Request for Proposal (RFP) / and or Invitation to Tender/Bid proposals. Compile Requests for Quotation (RFQs) proposals and Head of Terms. Perform qualification exercises to select bidders for RFP.
- Initiate and chair the RFP kick-off meetings. Initiate and chair RFP/BID clarification meetings, writes and issues minutes.
- Prequalify Contractors.
- Manage tender and project document registers. Facilitate the RFP evaluation process and performs commercial evaluations. Compile proposal summaries and award recommendations for approval.
- Manage all facets of the contract/subcontracts process/es.
- Participate in and/or lead negotiations, coordinate redlines related to contractual terms and conditions with legal, Contractor and other stakeholders. Negotiate business terms and collaborate, coordinate and be able to explain risks and implications of contract terms to the business and other stakeholders.
- Compile contract packages for signature and handles relevant contractual correspondence.
- Run contracts in a timely method with appropriate legal support to ensure compliance with company standards.
- Handles the administration procedures of the contracts and the relevant documentation, in coordination with the assigned contractors, service providers and consultants.
- Maintain trusted, productive relationships with the contractors associated with the Project/Program.
- Supports the management and the administration procedures of the Project/Program and other contracts in collaboration with Legal dpt.
- Collaborate closely with the key stakeholders, attend and facilitate meetings as necessary.
- Supports Project/Program Stakeholders requirements in collaboration with PMO Teams, Legal, Accounting & Finance. Reports accordingly to the PMO Director and the PMO Coordinator.
- Coordinates and roots the contractual correspondence and relevant.
- Track Contractor’s obligations and manage Employer’s obligations under the Project/Program and alerts the PMO Director for deviations and/or claims risks.
- Ensure that accurate site records are maintained and where necessary measuring and valuing work,liaising with the surveyor and the customer representative.
- Coordinate and route contractual communication between Employer’s Representative and the Contractor.
- Monitor subcontractors to ensure they are adhering to environmental commitments and
responsibilities.
- Monitor Projects’ delays which may occur at the implementation of works in coordination with the Project Management Team.
- Mapping and analyze of all the corresponding data in order to determine the liable party and assure that the relevant procedures of the contract with regards to extension of time (EoT), compensations or application of delays or liquidated damages are followed.
- Assess of contractor’s Claims and relevant substantiation documentation (delays’ analysis / time impact analysis / critical path analysis, delay, prolongation, disruption costs calculation, request for extension of time, etc.). Develops Employer’s defense against claims/requests under the contracts’ provisions.
- Identifies and escalates any contractual risks from third-party agreements.
- Performs active risk management as a part of contracts management, to anticipate and/or defend potential claims and/or variation requests and mitigate their impact.
- Formulate an opinion concerning the Contractor’s merits so as relevant strategy and actions will take place (acceptance, negotiation and dispute).
- Handle of contractual disputes. Deal with and mitigates disputes in close collaboration with the Senior leadership Team and Legal.
- Produce contractors’ performance reports against contractual and strategic performance
indicators.
- Work with Project Management to ensure Change Orders are processed promptly and correctly.
- Ensures that the change management process is in compliance with all Project/Program provisions.
- Ensure compliance with contracting guidelines or obtains deviations when necessary.
- Responsible review budget on a monthly basis as well as all invoices approved, and the owner billing reviewed and approved.
- Participate in various meetings, conversations and negotiations with key stakeholders. Follow up on requests and considerations shared by the senior leadership team.
- Receive and coordinate the payment of the Contractor’s applications with the Project Management.
- Check and verify monthly progress claim and variation orders for approval and payment. Processing variations. Coordinates the payment authorizations, including verification of conditions precedent for payment (securities, insurance, etc). Reports any emerging issues to the PMO Director and the PMO Coordinator accordingly.
- Actively involved in the Project/Progarmme contractual close out process.
- Sorting and boxing of Contract files after completion and eventually archiving
Qualifications and Experience
- Master’s or Bachelor’s Degree in Engineering or relevant field.
- PMP/CAPM certification preferred.
- Relevant Contracts Management certification preferred.
- 10+ years in Contract Management in complex demanding construction projects.
- Experience in Concession Projects preferred.
- Proficient verbal and writing skills in Greek & English.
- Very good negotiation skills. A strong and persuasive negotiator.
- Previous experience of working in a PMO will be advantageous.
- Logical approach to problem solving.
- Customer Focus, excellent written and verbal communication skills, adaptability and analytical thinking. Excellent interpersonal skills. Self-disciplined, good time management skills and capacity to self-motivate.
- MS Office Suite proficient user.
- Experience in working with multi-cultural project teams is preferred. Ability to work with minimum supervision whilst retaining a sense of team spirit.
- Dispute Resolutions and Arbitration Proceedings experience preferred.
